Océalliance, as the publisher of the website clicocean.fr (hereinafter the ‘Website’), collects, uses and shares various details that the users of our products provide us with through our Website.

This privacy policy supports our contractual commitments, including our Website’s terms and conditions of online sale (hereinafter the ‘T&Cs’). 

This privacy policy does not apply to mobile applications or websites published by third parties, whether or not they are partners of our company, towards which our Website may direct you.

For example, you provide us with your Personal Data when you buy one of our products, complete a registration form for our services, participate in a game, competition, promotional deal, study or survey, and contact us by any means.

- full name, address, gender, telephone number, email address, billing address, delivery address, your company’s SIRET number, and the full names, email addresses and job titles of your employees who have access to the Website

(ii)    automatically gathered data: When you use our products and services, we collect various information in a systematic, automated manner. That information primarily involves the following categories: 

- data relating to the device used when logging in and how our services are viewed and used: we may collect information about the devices you use to access our services and the networks from which you access them, including your IP address, log in data, type and version of the internet browser used, type and version of your browser’s plugins, operating system and platform, and data about your browsing path.

 

In any case, we only collect and process the data that is strictly necessary for the purpose for which they were collected.

 

And when we request information from you, we tell you whether it is mandatory or optional to provide that information, and inform you of the consequences of not providing the information. Only those fields marked with an asterisk are mandatory and required in order for us to provide you with a service, such as placing an order.

Children

Our Website is not designed for children under 16 years and we ask that minors not provide their Personal Data to Océalliance. If we realise that we have collected the Personal Data of a minor under 16 years old, we will take all the necessary measures to erase that data as quickly as possible.

 II.    Data retention period

In general, the collected data will be retained for a period not exceeding five (5) years from the date the Website was last visited. 

This retention period may be shorter if you request your account be closed or your Personal Data be erased. 

However, the retention period for certain data may exceed the five (5) year period stated above, in order for us to meet our accounting and tax obligations and, more generally, our legal obligations. This includes all transactions.

 III.    Usage of collected data

The collected Personal Data is used to: 

(i)             send you information about our services by all means of communication, including important security notices and notifications of any significant modifications made to this Privacy Policy, and provide you with high quality customer assistance.

(ii)            enable you to personalise our services and to enable us to correct and improve them in order to continue to provide the best service; your purchasing history enables us to provide you with better information when you visit our Website.

(iii)           inform location features: we collect location data only when you have authorised us to do so and for the exclusive purpose of providing you with services based on the location you request. These data are stored on your terminal and are not stored or processed by us.

(iv)           enable you to create an account to access certain services requiring prior registration, for example when you create an account and we ask for your email address and name in order to ensure your account’s security.

(v)            provide you with a customer and product assistance service and monitor the quality and nature of that service; when you communicate with an advisor or account manager from our customer service team by email or telephone, we collect Personal Data such as your name, postal address, telephone number, email address, contact preferences, and information about the Products you possess and the date of purchase. This enables us to create event journals for diagnosing product or application performance issues and to gather information about problems relating to support and services. In accordance with applicable legislation, we can also record and listen to your conversations with our customer service advisors and account managers, and analyse all comments voluntarily supplied through customer surveys, in order to improve our customer service. With your agreement, which you can withdraw at any time, our customer service team can log into your account to resolve issues, if required.

 IV.    Communication of collected data 

In order to provide you with the best service possible, we may share information about you, including your Personal Data, with third party companies that process them on our behalf in accordance with our instructions, current legislation, and this privacy policy. Your Personal Data will only be shared with partners that provide sufficient guarantees regarding the implementation of suitable technical and organisational measures to ensure the protection of your rights and Personal Data.

We may also be required to share certain data, including your Personal Data, either by law or if we believe in good faith that it is necessary for (i) responding to any complaints lodged against Océalliance, (ii) complying with any legally binding request, (iii) executing any contract agreed with our users, (iv) emergency situations where the public’s health or an individual’s physical safety is at stake, (v) investigations and inquiries, and (vi) protecting the rights, property and security of Océalliance, our users and, more generally, any third parties.

We store your Personal Data in our secure servers located within the European Union. However, the data we collect when you use our services may be transferred to other countries.

Right to access: You have the right to access the Personal Data we hold through your account (accessed through the Website or application).

Right to rectification: You have the right to request your Personal Data be immediately corrected and updated. 

Right to erasure (right to be forgotten): In the absence of legal provisions to the contrary, we will erase your Personal Data in order to comply with our legal obligations, including when your Personal Data are no longer needed or when you request they be erased.

Right to restriction of processing: You also have a right to restrict the processing of your Personal Data if you consider that the Personal Data are not accurate or you object to their use.

Right to data portability: You may ask us for a copy, in a structured format that is commonly used and machine readable, of the Personal Data you have provided to us when that data’s processing is performed by automated processes.  Right to lodge a complaint with a supervisory authority: If you believe that Océalliance has not upheld this privacy policy or that the rights given to you by the applicable legislation are not being properly protected by Océalliance, you have the right to lodge a complaint with a supervisory authority. Furthermore, we take all reasonable measures to notify each user, whose Personal Data has been communicated, of any corrections or erasure of the Personal Data and any restriction on processing imposed, unless that communication is impossible or requires disproportionate efforts.
